GENERAL OVERVIEW & LIABILITY WAIVER

The information below outlines key policies, procedures, expectations, membership terms and liability conditions that apply to any individual entering and/or participating in any NEXUS Martial Arts activity. By visiting NEXUS Martial Arts and/or participating in any class, event, open mat, trial session, or activity, I acknowledge and agree to the following:

ASSUMPTION OF RISK & PARTICIPATION TERMS: I understand and accept martial arts training involves inherent risks, including physical contact and strenuous activity that may result in serious injury, disability, or death. These risks may arise from my own actions, the actions or negligence of others, program rules, facility conditions, or equipment use. Additional, unforeseen risks may also exist. I agree to inspect all facilities, equipment and training partners before participating. If anything appears unsafe or beyond my ability, I will notify an instructor immediately and refrain from participating until the concern is resolved. I voluntarily assume all risks and accept full responsibility for any injury, disability, or death that may result from participation. I agree to follow all training and safety rules. I certify I’m in good physical condition and not advised by any medical or mental health professional to avoid physical activity. I authorize qualified medical personnel to administer emergency care should it become necessary. I release, waive and discharge NEXUS Martial Arts; its owners, instructors, staff, agents, volunteers, affiliates, members and the owners or lessors of the premises from all claims, demands, losses, or damages arising from injury (including death) or property damage, whether caused by negligence or otherwise, on behalf of myself, my heirs and next of kin.

MEMBERSHIP & PURCHASE INFORMATION: I understand NEXUS Martial Arts membership options, class offerings and class pack options are available at www.nexus-az.com. When purchasing any membership, class or class pack, it's my responsibility to review and understand the terms for the option I choose. I understand each membership has its own cancellation and pause policy. I also understand the X Pass, Striking Pack, individual classes and drop-in day passes are non-refundable and non-cancelable. By signing this document, I acknowledge I've reviewed and understand all membership, class and product options are available on the NEXUS Martial Arts website and I agree to the terms, policies and conditions associated with the membership(s) and/or product(s) I purchase.

IMPORTANT! THE FOLLOWING APPLIES TO ALL RECURRING AND MONTH-TO-MONTH MEMBERSHIPS:

• MEMBERSHIP TERMS, BILLING & AUTHORIZATION: You authorize NEXUS Martial Arts to automatically charge your designated payment method for all recurring membership payments, fees and any applicable charges associated with your selected membership until your membership is properly canceled in accordance with this Agreement. You acknowledge your membership is a recurring subscription and recurring billing has been clearly disclosed to you before purchase. Billing will continue unless your membership is properly canceled IN WRITING, BY EMAIL ONLY. No other form of cancellation will be accepted. Missed classes, dissatisfaction with services, schedule conflicts, relocation, illness, injury, vacations or other personal circumstances do not qualify for refunds, cancellation of future obligations or charge reversals.
• CANCELLATION POLICY: To cancel your membership, WRITTEN NOTICE must be sent by email to info@nexus-az.com or x@nexus-az.com at least 30 days before your next scheduled billing date. The date and time the cancellation email is received by NEXUS determines the effective cancellation date. EMAIL ONLY. NO EXCEPTIONS. We do not accept cancellation requests made in person, verbally, by phone, voicemail, text message, social media, third parties or through any other method. Failure to follow this cancellation procedure does not constitute cancellation. If proper notice is not received within the required timeframe, the next scheduled payment will be processed as authorized, valid and non-refundable.
• EARLY TERMINATION (APPLIES TO YOUTH, STANDARD & PROMOTIONAL MEMBERSHIPS): If you cancel your membership before completing your contracted membership term, you agree to pay an Early Termination Fee equal to 50% of the unpaid remaining contract balance, calculated as of the date your cancellation email is received. This fee is due immediately upon cancellation and does not replace any payment(s) due before your cancellation becomes effective under the Cancellation Policy.
• REFUNDS & CHARGEBACKS: You agree not to initiate or authorize a chargeback or payment dispute for any charge that complies with this Agreement. Before disputing any charge with your financial institution, you agree to contact NEXUS to allow an opportunity to resolve the matter directly. In the event of a dispute or chargeback, this Agreement, signed acknowledgements, attendance records, check-in history, payment history, email communications, account activity and any other business records maintained by NEXUS may be submitted as evidence. Filing a chargeback does not cancel your membership or relieve you of any contractual obligations. Improper or fraudulent chargebacks may result in collection efforts, additional fees where permitted by law and recovery of amounts owed.
• MEMBER RESPONSIBILITY: You are solely responsible for ensuring NEXUS receives your cancellation email. If you do not receive a written confirmation from NEXUS, you should contact us immediately. Members are responsible for maintaining current payment information and monitoring their payment method and email communications regarding their membership.
• NO VERBAL MODIFICATIONS: No employee, instructor or representative of NEXUS may modify these billing or cancellation requirements through verbal conversations, text messages or informal communications. Any exception or modification must be provided in writing by an authorized representative of NEXUS.

PHOTO | VIDEO | SOCIAL MEDIA CONSENT: I authorize NEXUS Martial Arts and its representatives to photograph and/or film me and/or my child(ren) and use all assets for marketing, promotional and/or social content. I understand NEXUS Martial Arts owns all photos and footage and may use and/or distribute them without limitation or compensation. I waive all rights to inspect or approve final materials and release NEXUS Martial Arts from any claims related to the use of this media.

FINAL ACKNOWLEDGMENT FINAL ACKNOWLEDGMENT: I have read this Overview, Liability Waiver, Release of Liability and Assumption of Risk. I understand I'm responsible for all purchases made with NEXUS Martial Arts, including, but not limited to, memberships, paid-in-full memberships, retail merchandise, services, fees and any other purchases. I acknowledge I've read, understand and agree to the terms, conditions, payment obligations, cancellation requirements, refund policies and all other provisions that apply to my purchase/s. I fully understand the contents of this document and acknowledge that I am giving up substantial legal rights by signing below. I understand this waiver is binding and my presence and/or participation at NEXUS Martial Arts confirms my agreement to all policies, terms, conditions and safety requirements outlined above. I am signing voluntarily, without inducement or guarantee and intend my signature below to serve as a complete and unconditional release of liability, as well as my acknowledgment and acceptance of all terms, policies and obligations described herein.
